What is a Wrongful Death claim in Texas?
In general, the term wrongful death refers to when a person dies as the result of the negligence (carelessness) of another, then that victim is said to have suffered a wrongful death. The surviving family members or the estate of the deceased has the right to pursue a wrongful death claim.
Texas Statutes section 71.001 defines wrongful death as one party’s “wrongful act, neglect, carelessness, unskillfulness, or default” causing the death of another. Negligence is conduct for which victims can be paid when injured or killed by a person that falls short of what a reasonable person would have done to prevent the circumstances from occurring.
For example, if a doctor fails to act in conformity with other doctors in his field and that failure caused your loved one to pass away, the doctor is liable for negligence. In an auto accident whether the other driver was negligent and struck your loved one, his negligent driving caused the accident and the wrongful death. In an auto accident scenario, a driver has a duty to operate his care in the way other people would reasonably operate their car. Cell phone use, driving erratically, failure to pay full time and attention, failure to observe traffic signals, driving under the influence of controlled substances or alcohol would establish negligence on the part of the defendant. Proving an act of negligence is an essential component of determining whether you have a viable wrongful death claim in Houston.
